A small red-and-white flag in an accessory photo is not enough information for a Florida equipment purchase. Ask where the warning device will be displayed and check its actual symbol dimensions, construction and visibility against the applicable rule. This is an evergreen buyer’s check of existing Florida law, not an announcement of a new October 2026 rule.
Snorkeling can fall within this statute
The 2026 Florida Statutes, section 327.331, includes a wholly or partly submerged person equipped with a face mask and snorkel in its definition of diver. Its display requirement has an exception for an area customarily used for swimming only. Do not assume that the absence of a scuba cylinder removes the question.
Compare the device with its intended display
| Purchase question | Statutory detail to check |
|---|---|
| Displayed from the water or a vessel? | The minimum divers-down symbol is 12 by 12 inches from the water, or 20 by 24 inches from a vessel. |
| Flag or buoy? | A defined buoy shows the symbol on three or four flat sides and may not be displayed aboard a vessel. |
| Flag construction? | The flag definition includes both faces, stripe orientation, proportions and a means of staying extended without wind. |
Ask the supplier to identify the symbol’s measured dimensions, not just the pole length, package size or a general “dive flag” label. Retain front and rear images and the written specification. A product photograph without a scale cannot resolve a minimum-size question.
A compliant-looking purchase is only one part of use
The FWC boating-regulations summary explains visibility, distance and display responsibilities. Its page states that the summary is current as of July 2025; the 2026 statutory text is the primary reference here. The statute also addresses navigation hazards, proximity to the warning device and removing the display when everyone is aboard or ashore. Check the full text for the actual setting.
Before ordering, give the local operator a simple description: the intended Florida venue, whether the group uses a vessel and whether the proposed device is a flag or buoy. Ask them to confirm the appropriate arrangement and any venue conditions. The device does not itself establish that access is allowed or that boat traffic will keep clear.
These references were checked October 31, 2026. A Florida-specific specification should not be copied into an equipment claim for another country or state without checking that jurisdiction’s rules.
Ask a useful equipment question
Read the TRIMIX buying guide for the inquiry process. To ask about actual supply or documentation, use product-context support and include the exact model, intended activity and the specification you need confirmed. An inquiry prepares an email; it is not an order or confirmation of availability.
